This Privacy Policy (Policy)
applies when you use our services (described below).
Please read the following to learn more about
our Policy.
TBA (“We” or “Us” or “Our”) may update this policy. We will NOT notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your TBA account. If we make material changes to the Policy, we will provide notice through our services, or by other means, to provide you the opportunity to review the changes before they become effective. If you object to any changes, you may close your account. You acknowledge that your continued use of our services after we publish or send a notice about our changes to this Privacy Policy means that the collection, use and sharing of your personal data is subject to the updated Policy.
This Policy covers how TBA collects and receives, including information related to your past use of TBA products and services. Personal information is information about you that is personally identifiable like your name, address, email address, or phone number, and that is not otherwise publicly available.
This Policy does not apply to the practices of companies that TBA or any other (found at http://www.texasbadmintonassociation.com) does not own or control, or to people that TBA does not employ or manage.
TBA collects personal information when you register with TBA. TBA may combine information about you that we have with information we obtain from business partners or other companies.
When you register we ask for information such as your name, email address, gender, and zip code. Once you register with TBA and sign in to our services, you are not anonymous to us. Your profile is fully visible to all members and customers of our services. If you sign up for a paid service, you will need to provide payment (e.g., credit card) and billing information.
TBA collects information about your transactions with us and with some of our business partners.
TBA only allows players who are 18 or older to participate in the league unless they are accompanied by a parent.
TBA does not rent, sell, or share personal information about you with other people or non affiliated companies except to provide products or services you've requested, when we have your permission, or under the following circumstances:
We provide the information to trusted partners who work on behalf of or with TBA under confidentiality agreements. These companies may use your personal information to help TBA communicate with you about offers from TBA and our marketing partners. However, these companies do not have any independent right to share this information.
We will share your personal data with our affiliates to provide and develop our services. We may combine information internally across the different services covered by this Policy to help our services be more relevant and useful to you and others.
We can also share your personal data as part of a sale, merger or change in control, or in preparation for any of these events. Any other entity which buys us or part of our business will have the right to continue to use your data, but only in the manner set out in this Policy unless you agree otherwise. In this event, TBA will notify you when information about you is transferred and becomes subject to a different privacy policy.
TBA displays targeted advertisements based on your personal information called sponsored content, which look similar to non-sponsored content, except that they are labeled “ads” or “sponsored.” If you take an action (such as like, comment or share) on these ads, your action is associated with your name and viewable by others, including the advertiser. Advertisers (including ad serving companies) may assume that people who interact with, view, or click on targeted ads meet the targeting criteria.
TBA does not provide any personal information to any third-party advertisers or ad networks when you interact with or view a targeted ad. However, if you view or click on an ad on or off our site or apps, the ad provider will get a signal that someone visited the page that displayed the ad, and they may through the use of mechanisms such as cookies determine it is you. By interacting with or viewing an ad you are consenting to the possibility that the advertiser will make the assumption that you meet the targeting criteria used to display the ad. Advertising partners can associate personal data collected by the advertiser directly from you. In such instances, we seek to contractually require such advertising partners to obtain your explicit, opt-in consent before doing so.
TBA works with vendors, partners, advertisers, and other service providers in different industries and categories of business.
A cookie is a small piece of data sent from a website and stored on the user's computer by the user's web browser while the user is browsing. TBA currently does enable cookies, mainly for the purpose of storing your password for easier login each time you visit the site. You will be given an opportunity to accept the use of cookies before your first visit to a site. After you are given a fair notice to opt-in, be aware that continuing to browse can be valid consent to the use of cookies.
We will contact you through email, mobile phone, notices posted on our websites or app, and other ways through our services. We will send you messages about the availability of our services, security, or other service-related issues. We also send messages about how to use the services, network updates, reminders, and promotional messages from us and our partners. You may change your communication preferences at any time. Please be aware that you cannot opt-out of receiving service messages from us, including security and legal notices.

New categories of marketing communications may be added to the Marketing Preferences page from time to time.
We reserve the right to send you certain communications relating to the TBA service, such as service announcements, administrative messages and the TBA Newsletter, that are considered part of your TBA account, without offering you the opportunity to opt-out of receiving them.
You have choices about the information on your profile. You don’t have to provide additional information on your profile; however, profile information helps you to get more from our services. It’s your choice whether to include sensitive information on your profile and to make that sensitive information public. Please do not post or add personal data to your profile that you would not want to be publicly available.
We retain your personal data while your account is in existence or as needed to provide you services. This includes data you or others provided to us and data generated or inferred from your use of our Services. Even if you only use our Services when once every few years, we will retain your information and keep your profile open until you decide to close your account.
For personal data that we have about you:1. Delete Data: You can ask us to erase or delete all or some of your personal data (e.g., if it is no longer necessary to provide services to you).
2. Change or Correct Data: You can edit some of your personal data through your account. You can also ask us to change, update or fix your data in certain cases, particularly if it’s inaccurate.
3. Object to, or Limit or Restrict, Use of Data: You can ask us to stop using all or some of your personal data (e.g., if we have no legal right to keep using it) or to limit our use of it (e.g., if your personal data is inaccurate or unlawfully held).
Right to Access and/or Take Your Data: You can ask us for a copy of your personal data and can ask for a copy of personal data you provided in machine readable form.
We log usage data when you visit or otherwise use our services, including our sites, app and platform technology (e.g., our off-site plugins), such as when you view or click on content or ads (on or off our sites and apps), perform a search, or install or update our mobile app. We use log-ins, device information and internet protocol (“IP”) addresses to identify you and log your use.
We use data, including feedback, to conduct research and development for the further development of our services in order to provide you and others with a better, more intuitive and personalized experience, drive membership growth and engagement on our services, and help connect other to each other and to increased gameplay.
Polls and surveys are conducted by us through our services. You are not obligated to respond to polls or surveys, and you have choices about the information you provide. You may opt-out of survey invitations.
TBA is not a storage service. You agree that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy. By submitting suggestions or other feedback regarding our Services to TBA, you agree that TBA can use and share (but does not have to) such feedback for any purpose without compensation to you. You promise to only provide information and content that you have the right to share, and that your TBA profile will be truthful.
You agree to only provide content or information that does not violate the law nor anyone’s rights (including intellectual property rights). You also agree that your profile information will be truthful. TBA may be required by law to remove certain information or content in certain countries.
With respect to Content you submit or make available for inclusion on publicly accessible areas of TBA Groups, the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Service solely for the purposes of providing and promoting the specific TBA Group to which such Content was submitted or made available. This license exists only for as long as you elect to continue to include such Content on the Service and will terminate at the time you remove or TBA removes such Content from the Service.
With respect to photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of the Service other than TBA Groups, the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Service solely for the purpose for which such Content was submitted or made available. This license exists only for as long as you elect to continue to include such Content on the Service and will terminate at the time you remove or TBA removes such Content from the Service.
With respect to Content other than photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of the Service other than TBA Groups, the perpetual, irrevocable and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other works in any format or medium now known or later developed.
"Publicly accessible" areas of the Service are those areas of the TBA network of properties that are intended by TBA to be available to the general public. By way of example, publicly accessible areas of the Service would include TBA Message Boards and portions of TBA Groups that are open to both members and visitors. However, publicly accessible areas of the Service would not include portions of TBA Groups that are limited to members.
We limit access to personal information about you to employees who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs.
We use your data (including your communications) if we think it’s necessary for security purposes or to investigate possible fraud or other violations of our User Agreement or this Policy and/or attempts to harm our members.
It is possible that we will need to disclose information about you when required by law, subpoena, or other legal process or if we have a good faith belief that disclosure is reasonably necessary to (1) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (2) enforce our agreements with you, (3) investigate and defend ourselves against any third-party claims or allegations, (4) protect the security or integrity of our service (such as by sharing with companies facing similar threats); or (5) exercise or protect the rights and safety of TBA, our Members, personnel, or others. We attempt to notify members about legal demands for their personal data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise to challenge every demand.
If you choose to close TBA account, your personal data will generally stop being visible to others on our services within 24 hours. We generally delete closed account information within 30 days of account closure, except as noted below.
We retain your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our User Agreement, or fulfill your request to “unsubscribe” from further messages from us. We will retain de-personalized information after your account has been closed.
Information you have shared with others will remain visible after you closed your account or deleted the information from your own profile, and we do not control data that other members copied out of our Services. Content and ratings or review content associated with closed accounts will show an unknown user as the source. Your profile may continue to be displayed in the services of others (e.g., search engine results) until they refresh their cache.
We implement security safeguards designed to protect your data. We regularly monitor our systems for possible vulnerabilities and attacks. However, we cannot warrant the security of any information that you send us. There is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
